Bankruptcy Law

Consumer Debtor Law

 

Just get served with foreclosure papers?  Just receive a threatening letter from a creditor?  

 

The South Carolina Consumer Protection Act and the Federal Fair Debt Collection Practices Act both impose certain duties on creditors.  If a creditor hasn't complied with certain statutory requirements, your case can be dismissed and you may even be entitled to damages if the creditor's behavior is egregious.  

 

You only have thirty (30) days to respond to a summons and complaint, so don't waste time and let the creditor obtain a DEFAULT JUDGMENT against you.

 

 

Wills/Estate Planning & Estate Administration

Real Estate Closings / Homeowner Associations

In South Carolina, lawyers are required to prepare the necessary documents associated with real estate closings.  With nearly 20 years of experience, I am prepared to handle both residential and commercial closings and/or refinances. 

 

​Can't get the homeowners to pay their dues? Your HOA is entitled to file a lien that affects the title to the real property, requiring that it be paid before it can be sold or refinanced. An association can also foreclose on its lien, just like a bank does when someone doesn't pay their mortgage.

 

Sometimes associations have other issues, such as noncompliance with fences, or parking boats or RVs on the roads or driveways.  I can help your association collect its unpaid dues and assist in enforcing other regulations. Contact me to discuss your association's options.
